Terms of Service of the Jobref Platform

§ 1 Preliminary provisions
- The subject matter of these Terms of Service is to define the terms and conditions for the provision of services through the Website maintained at www.jobref.com to customers in accordance with the Act of July 18, 2002 on the provision of electronic services.
- For the purposes of these regulations, the following definitions shall mean:
- Contact Form - means a form provided on the Website that allows an Advertiser to express interest in a given advertisement by submitting the Jobref's contact information in order to make it available to the Advertiser to whom the Contact Form pertains.
- Civil Code - means the Act of April 23, 1964. - Civil Code (Journal of Laws of 2022, item 1360, as amended).
- Account - means a place on the Website available to Users after logging in (providing login and password).
- Jobref - means Jobref Ltd. of Wallington, Unit 7 Vulcan House, Restmor Way Wallington, England, SM6 7AH, Company number 09088350, Tax Identification Number GB189 3913 58, e-mail: [email protected].
- Cookies - means text files saved by the web browser on the User's computer disk or mobile device in order to store information used to identify the User or to remember the history of his/her actions on the Website.
- Announcer - means an individual who (i) expresses his/her willingness to hire himself/herself as an employee and submits a job application to the Service or (ii) provides his/her contact information through the Contact Form or (iii) is redirected to the Announcer's pages to submit a job application or (iv) creates an account on the Service.
- Advertiser - means an individual, legal entity or organizational unit that is not a legal entity conducting business, who wants to hire an employee and submits a job advertisement on the Website or creates an account.
- Referral - means an individual who, with the help of the Service, sends another person potentially interested in an advertisement published on the Service information about this advertisement - Referral.
- Recommended Person - means an individual to whom the Referrer, with the help of the Service, sends information about an advertisement published on the Service.
- Reference - means a reference for a Job Advertisement directed by the Referrer to the Referrer.
- Privacy Policy - means the Personal Data Privacy Policy available on the Jobref website.
- Terms of Service - means these Terms of Service for the provision of electronic services on the Site.
- Regulation or GDPR-means Regulation 2016/679 of the European Parliament and of the Council (EU) of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
- Service - means the website operated by Jobref at www.jobref.com and www.dashboard.jobref.com and mobile application Jobref.
- Law on Providing Services by Electronic Means - means the Law of July 18, 2002 on Providing Services by Electronic Means (i.e. Journal of Laws of 2020, item 344, as amended).
- Copyright and Related Rights Act - means the Act of July 4, 1994 on Copyright and Related Rights (i.e. Journal of Laws of 2022, item 655, as amended).
- Personal Data Protection Act - means the Act of May 10, 2018 on the protection of personal data.
- Law - Electronic Communications Law - means the Law of July 12, 2024 - Electronic Communications Law.
- User, Users- means any person who uses the services offered by the Website.
- The object of the services provided by Jobref is to (i) receive job advertisements, (ii) prepare job advertisements for publication, (iii) publish job advertisements, (iv) receive job applications from Announcers, (v) forwarding job applications to the Jobref along with information on any referrals, or (vi) redirecting Jobrefs to the Jobref form, (vii) providing the Referrer with a form to send a referral to the Referrer (viii) providing the Jobref with the contact information of the Jobref via the Contact Form (ix) support services.
- Services are provided on the basis of a contract between Jobref and the advertiser and on the basis of a contract between Jobref and the referrer.
- The service of (i) accepting job applications, (ii) forwarding job applications with information about possible referrals, (iii) redirecting to the Announcer's form, (iv) providing the Referrer with a form to send a referral to the Referrer, and (v) the Announcer's account is provided to the Service Recipient pursuant to Article 393 of the Civil Code.
- The content of the Service forms a database of job advertisements (hereinafter: database) subject to protection under the Act on Protection of Databases of July 27, 2001.
§ 2 General principles
- The Service operates under the terms and conditions set forth in these Terms of Service. Each User is obliged, at the moment of undertaking activities aimed at using the services offered by Jobref, to become familiar with the provisions and comply with these Terms of Service.
- As a prerequisite for using the services of the Website, including the use of data contained in the Website, you agree to be bound by the terms of the Terms of Service.
- Announcements and Profiles on the Website are publicly available and anyone can read their content free of charge. Reading job advertisements does not result in a contractual legal relationship between Jobref and a third party.
- The Service is used exclusively for the use of the services referred to in §1.3. It is prohibited to use the Service for other purposes, in particular to promote other websites, products, or services.
- Jobref does not allow the use of the Website services anonymously or using a pseudonym, which is justified by the nature of the services provided, for which the identification of individuals is important. This does not apply to Referrers and Referrals.
- Jobref has a Privacy and Data Protection Policy, which is the subject of a separate document. The Privacy Policy provides detailed information on Jobref's processing and protection of personal data.
- Unless otherwise provided in the Terms of Service, downloading or secondary use for any purpose of a substantial part of the database contained in the Service is prohibited.
- It is not allowed to share the Account with other people.
- The use of data and information available after logging into the Account and information sent electronically (e.g., by e-mail) by Jobref is permitted only for the Service User's own purposes. In particular, it is forbidden to use, process, publish and make available to other third parties data, presentations, and other documents concerning Jobref or the Service without prior written consent of Jobref. Violation of the provisions of this paragraph by the User entitles Jobref to claim from the User compensation for damages on general terms.
- In order for the Service to function properly, the data entered by the User should be consistent with reality.
- Before concluding a contract, Jobref provides Users with the Terms and Conditions free of charge.
§ 3 Provision of services
- Job Ref provides Referral Program services consisting of:
- providing the Advertiser with the possibility of placing a job ad on the Jobref platform;
- providing users with a unique link to a job advertisement in order to forward it to a potentially interested recipient,
- providing users with a public link to a job advertisement in order to pass it on to potentially interested recipients,
- forwarding received job applications to the advertiser with information on referrals,
- redirecting Referrals to the Advertiser form,
- ensuring the proper functioning of the Jobref Platform,
- ancillary services
- In providing its services, Jobref undertakes to take steps to find an employee/collaborator for the Advertiser through a referral system, and in particular to:
- to receive job applications from advertisers on behalf of the advertiser, together with information on possible referrals,
- forwarding these applications to the Announcer, making the accepted applications available within the Announcer's Account for a period of 12 months from the submission of the application,
- redirect Referrals to the Advertiser form,
- provide the Referrer with a form to send a referral to the Referrer,
- publish the extended profile created by the advertiser on the Jobref Platform
- The advertiser for whom Job Ref provides services undertakes to:
- send Jobref the information necessary to publish a job advertisement on the Jobref Platform,
- publication of job advertisements in accordance with the applicable legislation,
- the processing of candidates' and referrers' personal data in accordance with the applicable provisions of GDPR, i.e. in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation);
- comply with the provisions of the Jobref website regulations,
- comply with Jobref's Privacy Policy;
- comply with the rules for posting content on the Jobref Platform,
- timely payment for services performed by Jobref to him
- to conclude agreements with Referrals through the Jobref Platform in the event that the applicant has applied through the aforementioned Platform as a result of a referral link received,
- inform Jobref about the completed recruitment
- inform Jobref of the fulfilment of the prerequisites updating the obligation to pay Jobref the employment commission or provide a copy or a scan of the candidate's contract termination by posting it in the Jobref panel when the status changes to "Contract Ended"
- In order to use the services offered by Jobref, it is necessary for the Advertiser to create an Account on the Jobref Platform under the "Admin Panel" tab at dashboard.jobref.com. An advertiser may only have one Account with a given email address. The creation, maintenance, and cancellation of an Account are free of charge.
- By publishing a job advertisement on the Jobref Platform, the advertiser has the possibility of using the Referral Programme to search more effectively and quickly for an employee or collaborator.
- If an advertiser uses the Referral Programme, the Service User can download a unique or public link which they can pass on to a potentially interested person or group of people
- If the Referrer uses the unique link provided by the User and thus submits their application for the advertised position and is hired, this updates Jobref's obligation to pay the agreed amount of remuneration.
- The advertiser is obliged to notify Jobref immediately, via the Jobref Platform or by sending an email to [email protected], of the employment of the Referrer, no later than 7 days from the date of his/her employment.
- When changing a candidate's status to Hired/Probation or Employed/Trial Period for a Referrer, the Advertiser is obliged to declare the final remuneration amount.
- The final amount of remuneration offered to the Referrer shall not be lower than the salary range set out in the published advertisement
- After the Advertiser hires the Referrer and the trial period elapses, Jobref issues the Advertiser with a VAT invoice for the amount agreed between the Advertiser and Jobref
- The date of payment of the VAT invoice is agreed by the Parties to be 7 days from its delivery to the advertiser.
- In the event of non-payment of the VAT invoice by the due date, the advertiser will not be able to add further job advertisements, as well as to use the Referral Programme. Once the outstanding VAT invoice has been paid, all services will be made available again
- In the event that the Referrer does not work the required period, the Advertiser shall not be obliged to pay Jobref the remuneration.
- The advertiser must provide Jobref with a copy or scan of the termination of the contract with the advertiser by attaching it on the Jobref Platform under the "Admin Panel" tab at dashboard.jobref.com when changing the statute to "Contract Ended.
- Jobref is entitled to remuneration for the employment of the Referrer by the Advertiser and the continuation of the employment/co-operation relationship with the Referrer after the end of the probationary period.
- Jobref's remuneration is calculated automatically after the Referrer has completed the trial period. If the Advertiser does not notify the termination of the agreement with the Referrer before the end of the trial period, Jobref shall immediately invoice the Advertiser in accordance with the remuneration agreed by the Advertiser
- In the event of failure to comply with the obligation to notify Jobref of the termination of the contract with the Referred Party before the end of the trial period, the Advertiser shall be obliged to pay Jobref remuneration in accordance with the provisions stipulating that the Referred Party has worked for the entire trial period.
- The amount of remuneration is determined on the basis of the payment method chosen by the advertiser with Jobref, either when the advertiser creates an account or each time before publishing an advertisement
- The detailed price list for Jobref remuneration is attached as Appendix 1 to this document. Any changes to the content of Appendix 1 do not constitute an amendment to the General Terms and Conditions of the Agreement.
- The basis for the calculation of the commission is the remuneration of the Referrer, i.e. the employee/co-worker/contractor.
- In the event of an employment contract between the Advertiser and the Referrer, the basis of the commission is the employee's gross salary.
- In the case of a contract of mandate or a B2B cooperation agreement between the Advertiser and the Referrer, the commission is based on the net amount of the remuneration
- The agreement is concluded for an indefinite or definite period, depending on the arrangements made between Jobref and the Advertiser.
- Either Party may terminate the Agreement by giving 30 days' notice.
- Termination of the Agreement shall not affect the ongoing trial periods of Advertisers employed by the Advertiser and the remuneration due to Jobref for the Referred Person's work during the entire trial period.
- In the event that the advertiser gives notice of termination, the entire amount due for the VAT invoices issued shall become due no later than 14 days after the notice of termination is given
- In the event that the Advertiser concludes a contract with the Referrer in disregard of Jobref and the terms and conditions of this Agreement, or in the event that the Advertiser fails to inform Jobref of the conclusion of the contract in accordance with the obligation indicated in § 3, paragraph 7, the Advertiser shall be obliged to pay Jobref three times the amount that would have been the basis of the commission, i.e. three times the monthly remuneration of the Referrer.
- In the event that the contract with the Referrer is ostensibly terminated by the expiry of the periods indicated in § 3 of the Agreement and another contract is entered into with the Referrer bypassing Jobref, the Advertiser shall be obliged to pay Jobref three times the amount that would have been the basis for the commission, i.e. three times the monthly remuneration of the Referrer
§ 4 Advertiser
- The Advertiser is a natural person, legal person, or organizational unit that is not a legal person conducting business activity, who wants to hire an employee and creates a job advertisement on the Jobref Platform, sets up an Account, or concludes a contract via the Jobref Platform for services offered by Jobref. The services of the Jobref Platform for the Advertiser in the scope of the referral program are subject to a fee.
- The service provided to the Advertiser consists of: Maintenance of the Advertiser's Account, acceptance of a job advertisement, preparation of a job advertisement for publication, publication of a job advertisement, acceptance on behalf of the Announcer of job applications from Advertisers with information about a possible referral, transmission of these applications to the Announcer, making accepted applications available within the Announcer's Account for a period of 6 months after submission of the application (after that the applications are automatically deleted), redirecting Advertisers to the Announcer's form, providing the Referrer with a form to send a referral to the Referrer, publication of the profile.
- In addition to the services indicated in paragraph 2 above, the Advertiser may also use the Contact Form service, through which Advertisers may express their interest in a given advertisement of the Advertiser . In case of using this service, the Advertiser is obliged to fulfill its information obligations to the Advertisers.
- Services to the Announcer are provided through the Account
§ 5 Account - Advertiser
- An Account can be created by any Advertiser. An advertiser may have only one Account with a given e-mail address. Establishment, maintenance and cancellation of the Account is free of charge.
- Establishment of an Account occurs after the submission of the appropriate instruction. Establishment of an Account may also take place after the publication of an announcement. In this case, the data for the Account will be taken from the announcement.
- You create an Account after you have read and accepted these Terms and Conditions and Privacy Policy.
- An instruction to set up an Account may be given by a person authorized to represent the advertiser in the recruitment of employees .
- Logging into the Account is done with the help of a login and password.
- With the help of the Account, it is possible to edit already published ads, monitor the history of submitted ads and monitor applications received.
- The advertiser may cancel the Account at any time by submitting an appropriate instruction, i.e. by sending an email to the email address specified in § 1.2.4 of the Terms of Service. Liquidation of the Account will take place within 24 hours after the instruction is submitted.
- Account deletion affects published job advertisements, namely, on the day of account deletion, the advertisements are automatically archived. Jobref is not responsible for interrupted recruitments due to the deletion of the account by the Advertiser. In such a case, Advertisers, including the Recommender and the Recommended Person, should contact the Advertiser directly, and any claims related to the advertisement posted by the Advertiser should be directed against the Advertiser.
- Jobref informs Announcers about the submission of an instruction to resign from the Account by the Advertiser and about the deletion of the account by the Advertiser, via e-mail to the address provided by the Announcer.
- Jobref may delete an Account if the Advertiser violates the provisions of these Regulations or the provisions of generally applicable Polish law. In the event of deletion of the account, the provisions of paragraph 8 above shall apply
- The advertiser can create his/her profile on the Account, which is available to all Users of the Service. The Advertiser may supplement their profile with, among others, the following content:
- Advertiser's company logo;
- Advertiser's company description;
- Key people from the Advertiser's company;
- Advertiser's address.
- The profile consists of the Announcer's identifying information, the Announcer's job advertisements and an editable part by the Announcer. Information provided in the profile should be in Polish, complete, true, non-discriminatory and not misleading. It is prohibited to include information of a sexual nature in the profile. Jobref is authorized to remove language errors in the profile, in particular to remove spelling and grammatical errors.
- After creating a company profile, the Advertiser may enter into a paid cooperation agreement with Jobref via the Jobref Platform regarding the referral program service offered by Jobref, which will specify the terms of cooperation and payment.
§ 6 Submission and approval of advertisement – Announcer
- The announcement form may be filled out and approved only by a person authorized to represent the Announcer on the basis of the relevant authorization or authorized to represent in the field of employee recruitment.
- It is forbidden to fill out and approve job advertisement forms using bots or other automated e-mail programs.
- A job advertisement is submitted by completing and approving a form. The form should contain data describing the job position in accordance with the current form on the website. In the case of submitting an advertisement without the mediation of the Account, it is also necessary to provide data identifying the advertiser and a jpg format graphic file with the advertiser's graphic mark. All fields marked as mandatory should be completed.
- The advertiser declares that he/she holds full copyright or appropriate licenses to the content of the advertisements and logos referred to in paragraph 3 above, which he/she publishes on the Site. The advertiser bears full and exclusive responsibility for the content of the advertisements and logos posted with respect to third parties, and undertakes to cover the costs associated with satisfying the claims of persons whose rights have been violated as a result of the content, publication or other use of the advertisement. The advertiser is also responsible for the compliance of the ad with applicable laws.
- After completing and approving the form, the advertiser will receive a confirmation email with the assigned ad number.
- Jobref prepares the announcement for publication by automated means.
- The advert will be published on the Website within 24 hours of the advertiser's approval of the form. The advertisement is published automatically.
- The job advertisement will be available on the Site for 30 days from the moment it is published. The ad is published in the first position (at the top of the list of ads on the Site) and will continue to occupy further positions as new ads are published.
- To renew the service, the advertiser should submit a new announcement with the same content.
- Jobref provides a form for Advertisers to apply for jobs. Upon completion and approval of the application by the Job Advertiser, the application will be automatically saved in the Job Advertiser's Account or will be redirected to the email address indicated by the Job Advertiser in the Job Advertisement published on the Site Jobref will keep the application for no longer than 6 months from the date of submission of the job application, and a backup copy of the application for 5 years from the date of receipt of the application.
- Jobref provides a form for sending referrals to potential candidates. After the Referrer completes and approves the form, the referral is sent by the Referrer through the Service to the Referrer's email address.
§ 7 Content of the announcement – Announcer
- The advertisement should include an offer of paid work for an individual with or without business activity. The job offer can be for any legal form of employment, especially under an employment contract or a contract of mandate.
- The announcement should be made in Polish or English
- The advertisement should contain an actual job offer. Sham job offers are prohibited.
- The work offered and the conditions under which the work is performed must be in accordance with the law.
- The ad must not seek to violate the law, in particular, the job offer must be for legal work.
- The information and other materials contained in the advertisement should be complete, true, appropriate, non-discriminatory and not misleading. Sexual ads are prohibited.
- The ad must contain a specified salary, i.e., a salary stated in a specific amount or marked with a range from X amount to Y amount. Providing your salary is necessary to submit the form and calculate the Jobref commission.
- Only the following information may be requested from the Announcer in a job advertisement:
- First name(s) and last name,
- email address,
- Linkedin URL (optional);
- course of previous employment
- Custom text field;,
- other personal data, if the provision of such data is necessary due to the exercise of special rights under the labor law.
- Jobref allows you to change the content of the announcement, which does not change the announcement in substance, such as the personnel requirements or the technology used in the project. Changes can be made using the Account.
§ 8 Advertiser - processing and entrustment of personal data processing
- The advertiser is the controller of the personal data of the advertisers - candidates who submitted a job application with a resume via the provided advertisement form.
- The advertiser is also the controller of the Referrers' personal data, which goes to the advertiser when the Referrer decides to apply for the referred advertisement. The Referrer's personal data is processed by the Advertiser to thank the Referrer for recommending the candidate.
- The advertiser, if it has expressed a desire to use the Contact Form service (has selected the Contact Form function in the advertisement), is also the controller of the personal data of the Advertisers who have sent the Contact Form. The Announcer, as the administrator of the data of the Announcers, is obliged, within 1 month from the date on which the Jobref provides it with such personal data, to fulfill its information obligation to the Announcers who sent the Contact Form.
- The advertiser, as the controller of the personal data of the announcers - the candidates who submitted a job application with their resumes and the Referrers whose data went to the advertiser (the Referrer submitted the application), should place the content of the information obligation and the relevant consent clauses under the forms of the recruitment advertisement.
- The advertiser shall ensure that appropriate technical and organizational measures are implemented so that data processing meets the requirements of the Terms of Service and protects the rights of data subjects.
- Jobref undertakes to process the Entrusted Personal Data only to the extent and for the purpose necessary to provide the Advertiser with the service described in § 4.2 of the Terms of Service.
- Jobref shall ensure that the persons authorized by it to process personal data have committed themselves to secrecy and/or are subject to the relevant statutory obligation of secrecy.
§ 9 Advertiser - price of service - Referral Program
- For the provision of Referral Program services, the Advertiser is obliged to pay the fees due for the services provided, under the terms and conditions selected on the Jobref Platform.
- The advertiser agrees that Jobref may issue VAT invoices without signature and receive invoices electronically, to the e-mail address indicated during Account registration.
- The advertiser registered for VAT purposes in an EU country other than Poland is obliged to provide a valid, correct and verifiable individual VAT identification number in the VIES system or declare that he does not have such a number.
- If an advertiser registered for VAT in an EU country other than Poland pays the remaining price to the Company at the Polish VAT rate for domestic transactions, its content will be published after the amount is credited to the Service's account.
§ 10 Copyright – Advertiser
- The advertiser declares that:
- advertisement and Profile does not violate the rights of third parties, in particular, the copyrights and personal rights of third parties,
- disposes of the relevant proprietary copyrights to the trade names and graphic and word marks provided in the advertisement, Profile or Account.
- The advertiser grants Jobref a non-exclusive license to use the trade names, graphic and word marks (hereinafter: works) provided in the advertisement, Account or profile for the purpose of providing the service, at the time of their posting on the Service and for marketing purposes.
- The license is granted for an indefinite period of time. Jobref is entitled to grant sublicenses to third parties for the purpose of providing the service.
- The license referred to in paragraph 2 is granted for the following fields of exploitation:
- In terms of recording and reproduction of works - production of copies of the work by a specific technique, including magnetic recording and digital technique,
- With regard to the circulation of copies - marketing, lending or leasing of copies, translation, adaptation, rearrangement or any other changes to the works, with preservation of the rights of the person who made these changes,
- In terms of dissemination of works in other ways - public performance, exhibition, display, reproduction, as well as broadcasting and re-broadcasting, as well as making the works available to the public in such a way that anyone can have access to them at a place and time of their own choosing, including the Internet,
- for use in promoting and advertising the activities conducted by Jobref
§ 11 Deletion of advertisement - Advertiser.
- Jobref is entitled to remove an advertisement or Profile from the Website at any time for reasons attributable to the advertiser, as well as for reasons beyond its control.
- Jobref has the right to refuse to accept or publish an advertisement or Profile for reasons attributable to the advertiser.
- A cause attributable to the advertiser is, in particular, a violation of these Terms of Service or generally applicable law by the content or form of the advertisement, as well as by the advertiser's own act or omission.
§ 12 Announcer
- An Announcer is an individual who expresses his/her willingness to employ himself/herself as an employee and submits a job application to the Service or is redirected to the announcer’'s pages to submit a job application or creates an Account on the Service or submits a Contact Form through the Service.
- The announcer may be self-employed.
- The services of the Service, indicated in paragraph 1, are provided to the Announcer free of charge in full. Jobref does not charge any fees for providing the aforementioned services to the Announcer.
- Acceptance of the application after it is filled out and approved by the Announcer and forwarding of the application to the Announcer or redirection to the Announcer's pages for job application is automatic.
- The Anouncer may communicate with Jobref using the means of communication indicated in § 1 section 2 point 4 of the Regulations, and with the Advertiser via the "Messages" function, which preserves the anonymity of the Announcer by not disclosing, among other things, his e-mail address and telephone number.
- The job application along with the Announcer's resume is scanned for scoring using AI in terms of the consistency of the Announcer's competencies with the job advertisement for which he applied. The result of the scoring will be made available to the Advertiser.
§ 13 Account - Announcer
- An Account can be created by any natural person. An advertiser may have only one Account with a given e-mail address. Establishment, maintenance and cancellation of an Account is free of charge.
- The Account is established through the designated social network: Facebook, Twitter, Google and LinkedIn. Identification data, with the consent of the Announcer, will be downloaded from the indicated social network. The Advertiser always has the option to manually update the identification data downloaded from the indicated social network.
- An Account may also be created using an e-mail address. In order to create or use an Account using an e-mail address, it is necessary to have an e-mail account. In order to create an Account the Announcer:
- fills out the registration form by providing personal information: e-mail address, password;
- accepts the Terms and Conditions and Privacy Policy,
- selects the "register" option.
- The Jobref sends an email with an activation link to the email address provided during registration, containing information about the Administrator and other information required by Article 13 of the GDPR and information that the personal data provided for registration is processed for the purpose of concluding the Agreement until the Advertiser clicks on the activation link, and after clicking on the link, for the purpose of performing the Agreement and for the Administrator's legitimate interests. Once the activation link is clicked, the User is registered and the Agreement is concluded. The activation link is valid within 48 h from the day it is sent. An account is established when the link is activated.
- The Advertiser acknowledges that by publishing data and information in the Account profile they will be publicly available within the Service. The Announcer may change the visibility of his/her published data at any time by changing the Account settings.
- In the event that an Advertiser applies for an advertisement posted on the Service by an Advertiser, an Advertiser's profile including data marked as visible by the Advertiser is made available to the Advertiser along with the Advertiser's application.
- The advertiser may consent to the processing of his/her data for the purpose of recommending him/her in future recruitments similar to the applied positions. The Advertiser expresses the consent referred to in this paragraph at the time of submitting an application for a position or at the time of sending the CV to the Jobref Platform.
- The advertiser may cancel the Account at any time by sending an email to the email address l.
- The Announcer may resign from the Account at any time by deleting it via the Jobref Platform, in the "My Profile" tab. The Account will be closed within 24 hours after Jobref receives and reads the email in question.
- Account deletion does not affect submitted job applications.
- Jobref reserves the right to remove content published by the Announcer within the Account and the Service in case of violation of the Terms of Service by the Announcer.
- The User's account may also be removed by the Service in the event of violation by the User of the provisions of the law or the provisions of the Terms of Service of the Service.
- After the Service finds that the User has violated the Terms of Service, the Service will send a request to the User's e-mail address to cease activities that are inconsistent with the Terms of Service and will delete the account within 48 hours if the User continues to violate the Terms of Service.
§ 14 Rights and obligations of the Announcer
- The job application should be written in Polish or English, if such a possibility is clearly indicated in the job advertisement.
- Information provided in a job application should be complete, truthful and not misleading. It is forbidden to include information of a sexual nature in job applications.
- A job application should contain an actual response to a job offer. Sham job applications are prohibited.
- The job application must not seek to violate the law, in particular, the application must not seek to illegally obtain information from the advertiser.
- An advertiser may be required to provide only the following data in a job application:
- First name(s) and last name,
- email address,
- phone number
- Linkedin URL (optional);
- course of previous employment
- Custom text field;,
- other personal data, if the provision of such data is necessary due to the exercise of special rights under the labor law.
- If the job advertisement will directly or indirectly require other data than that indicated in paragraph 5, Jobref requests that such information be provided to Jobref immediately.
- The provisions of the job advertisement shall apply directly to the resume form, unless the provisions of the Terms of Service expressly provide otherwise.
§ 15 Refferal
- A Referal is an individual who, with the help of the Service, sends another person potentially interested in an advertisement published on the Service information about this advertisement - a Referral.
- The Referal may set up their profile on the Jobref Platform by registering using a Google, Apple or LinkedIn account or by e-mail address, creating a password for the account by entering a 6-digit activation code. When setting up an account, the recommender fills in the required fields, i.e. first and last name and e-mail address. In the case of registration using a Google, Apple or LinkedIn account, Jobref, with the Referral's consent, may automatically fill in the above data, using the data indicated by the Recommender in the Google, Apple or LinkedIn account.
- Optionally, when registering an account, the Referrer may provide:
- LinkedIn URL,
- Current role,
- Tech Stack.
- If the Referral consents to sending commercial information, Jobref may send notifications about current recruitments.
- In the event that the Announcer employs the Advertiser based on the Referral's recommendation, the Referral is entitled to remuneration for employing the Recommended Person by the Advertiser and for continuing the employment/cooperation with the Recommended Person after the trial period, in accordance with the commission table made available via Jobref.
- The basis for calculating the commission is the amount of Jobref's remuneration received from the Advertiser.
- The Referral receives the remuneration set out in the agreement if all of the following conditions are met:
- The Referral sends the Recommended Person a link to the job advertisement or shares it on their social media,
- The Recommended Person applies for the position from the provided link,
- The Recommended Person successfully completes the recruitment process,
- The Recommended Person is employed by the Advertiser,
- The Recommended Person works for the Advertiser after the trial period specified between Jobref and the Advertiser,
- The Advertiser pays the invoice issued by Jobref for the commission for obtaining the candidate.
- Notification about the submission of an application by the Recommended Person is sent to the Referral automatically.
- The Referral and the Recommended Person may communicate with Jobref using the means of communication indicated in § 1 section 2 point 4 of the Terms of Service.
§ 16 Referral program
- If the Advertiser hires a candidate through a referrer, they are obliged to pay Jobref the agreed remuneration based on the terms of cooperation referred to in § 3 or the payment terms selected on the Jobref Platform.
- If an advertiser hires a referral, the Jobref accurately determines the time when the candidate was referred and when he or she applied for the position, in order to determine when the referral and application occurred in case the advertiser believed that the candidate had previously applied on his or her own through the Service rather than through a unique URL from a referral.
- When changing the status of a candidate from a referral, the advertiser is obliged to declare how much the candidate's final salary is. The salary cannot be less than the lower value of the fork included in the job advertisement.
- Once the candidate's status is changed to "Hired", a trial period begins, the duration of which is specified in the cooperation framework agreement or selected when creating the company's profile on the Service.
- After the expiration of the probationary period, if the candidate is hired for a further period, the Jobref will issue a VAT invoice for the amount resulting from the cooperation framework agreement, plus 23% VAT.
- If a candidate, after being hired by the Announcer, gives notice of termination before the end of the probationary period, the Announcer will not be charged a commission for hiring the referred candidate. In this case, the Announcer is required to provide a copy or scan of the termination by attaching it in the Jobref panel when changing the status to "Contract Ended". Then Jobref informs the Referral about the termination of the contract between the Advertiser and the person recommended by him, via e-mail or the Jobref Platform.
- The advertiser has access to the referrer's data only in terms of his/her data such as name, surname and Linkedin URL. The advertiser can contact the referrer using Jobref Company's Admin Panel, using Jobref Admin Panel (dashboard.jobref.com) and the built-in functionality for sending and receiving messages
- The advertiser can give a rating to the referrer if the candidate's status changes to "Rejected" or "Hired". Issuing a review involves rating by giving the recommender 1 to 5 stars. The referrer's rating is visible on the referrer's profile for Announcers.
- The referrer will receive the remuneration established in the framework cooperation agreement concluded with Jobref if the following conditions are met together:
- The referrer will send the candidate a link to the job posting or share it on their social media
- The candidate will apply for the position from the link provided
- The candidate will pass the recruitment process
- The candidate will be hired by the Announcer
- Candidate will work for the Announcer after a trial period specified between Jobref and the Announcer
- The advertiser will pay the invoice issued by Jobref for the commission for obtaining the candidate
- The recommender has access to the referred candidate's data such as name and surname, and has access to the candidate's Match Score.
- The advertiser has access to the candidate's data only if the candidate applies for the position through a link from the referrer or directly through the Service. The advertiser does not have access to the data of candidates to whom the link to the offer was sent by the referrer.
§ 17 Candidate Recruitment Statuses
- New - the status of any candidate who applies for a position directly through the Service as well as from a referral link.
- Processing - the status of the candidate against whom the Announcer begins the recruitment process.
- Rejected - the status of a rejected candidate. Then the advertiser can evaluate the referrer if the candidate applied through the referral link.
- Hired (Probation) - the status of an employed candidate who has not yet completed the probationary period.
- Hired means the employed status of the candidate. Then the advertiser can rate the referrer if the candidate applied through the referral link.
- Contract ended - means the status of an employed candidate whose cooperation with the Advertiser ended before the trial period expired. This applies to both the termination of the contract by the Advertiser and the candidate.
- Direct Referral - the designation of the candidate on the list that candidates who applied to the ad have based on a unique link valid for one candidate's application
- Public Referral - the designation of a candidate on the list that is held by candidates who applied to the ad based on the public link generated by the referrer and published on social networks.
§ 18 Rights and obligations of the Referral
- The information provided in the Referral should be complete, true and not misleading. It is prohibited to include information of a sexual nature in the Referral.
- The Referral should contain real data of the Referrer and the Referred. It is forbidden to send information using the Referral form for any purpose other than to inform about the advertisement published on the Website, in particular, it is forbidden to send sham Referrals.
- The command must not seek to violate the law, in particular, the command must not seek to illegally obtain information.
- The Referrer may be required to provide in the Referral only those data listed in § 15(2) of the Terms of Service.
- The Referrer acknowledges and agrees that the Referrer may effectively prohibit Jobref from processing his/her personal data, which will make it difficult to determine the performance of the designated activity referred to in § 6.11.
§ 19 Liability rules
- Jobref is not responsible for the content of advertisements and Profiles submitted by the advertisers. Jobref declares that the preparation (by Jobref) for publication of job advertisements and Profiles is formal in nature and, as a rule, does not interfere with the content of the advertisements and Profiles.
- Provision of incorrect or incomplete identification data by the Announcer may result in the non-performance or incorrect performance of the ordered services, for which Jobref is not responsible.
- Jobref is not responsible for:
- The correctness and timeliness of the data contained in the advertisers' announcements and for their selection or suitability for specific purposes,
- decisions or actions that the Announcer will take based on the data contained in the Service, including advertisements, and for their selection or suitability for specific purposes,
- improper and not culpable by Jobref operation of the mechanisms of the Service,
- any damage resulting from the manner in which users use the Website, insofar as such actions by users do not constitute normal use of the Website in accordance with its intended purpose,
- content made available by the User as a result of using the services, which content violates the law or the legally protected property of third parties (including works as defined in the Law on Copyright and Related Rights),
- lack of authenticity of information and data provided by Users on the Service or information about Users shared with other Users,
- consequences resulting from third parties coming into possession of the User's access password, if this occurred through the fault of the User,
- information downloaded by the User from the Internet and for the consequences of its use by the User,
- consequences and damages related to the public release of the Announcer's personal data and other content posted by the Announcer through the electronic resume or Account,
- making public on the Website, including, in particular, within the Account and the electronic resume of one's image by the Announcer,
- services, applications and websites provided by third parties,
- Jobref does not guarantee to the Announcer that anyone will apply for a job, the veracity of the applications submitted, the economic value to the Announcer of the applications submitted, or the employment of anyone in the position advertised.
- Jobref does not guarantee the advertiser that the advertiser will contact, offer a job or hire.
- Jobref, once the job application or Contact Form has been submitted to the advertiser, does not participate in the contacts between the advertiser and the job seeker and is therefore not responsible for them.
- Jobref does not guarantee to the Advertiser that anyone will send a Referral. It also does not guarantee the veracity of the Referrals sent or the economic value to the Advertiser of the Referrals sent.
- Jobref, after the Referrer sends the Referrer information about the advertisement published on the Service, does not participate in the contacts between the Referrer and the Referrer and therefore is not responsible for them.
- Jobref, after providing the Advertiser with the application completed with the Referrer's name(s), surname and e-mail address, does not participate in the contacts between the Advertiser and the Referrer and therefore is not responsible for them.
- The Referrer declares that by providing the Referrer's data he does not violate the rights of the Referrer or any other third party, in particular, the provision of such data does not violate trade secrets or other secrets protected by law. The Referrer agrees to accede to the debt if anyone makes a successful claim against Jobref in connection with the provision of the Referrer's data by the Referrer.
- The service is provided on an "as is" basis, that is, it is available in the current version which may contain defects and there is no better alternative version. Therefore, Jobref does not provide any guarantee for the services provided, including quality guarantees.
- Jobref does not guarantee that the servers of the Site are free of computer viruses and other malware, and therefore is not liable for damage caused by computer viruses and malware.
- Jobref does not guarantee that the content of the Service, including the advertisements themselves and Profiles, will be free from defects, in particular inactive links, inaccuracies or typographical errors.
- Jobref is not responsible for lost benefits.
- Neither the advertiser nor other persons to whom paid services are provided may claim from Jobref, by contract or on any other basis, compensation whose total amount would exceed 50% of the fee paid for the paid service.
- The above limitations of liability do not apply to damage caused by the willful misconduct of Jobref, nor will they apply to the extent that they are prohibited under applicable law.
- The advertiser, advertiser and referrer shall be obliged to indemnify Jobref for any damages incurred by Jobref in connection with the content of the submitted job advertisement, job application or referral, including the necessary costs of litigation, court entries, costs of legal representation and other reasonable expenses of Jobref incurred in connection with claims of third parties or advertisers, advertisers and referrers themselves.
- Jobref reserves the right to temporarily not provide services if it is not possible to provide services due to fortuitous events beyond Jobref's control (e.g. fire, flood, war, strike).
- Jobref reserves the right to introduce technical interruptions in the operation of the Website at the rate of 24 hours per quarter. To the extent possible, Jobref will perform this work during nighttime hours, i.e. between 24:00 and 6:00 AM. Jobref shall make every effort to notify Users of planned maintenance, repair activities and those related to modification and development of functionality.
§ 20 Security and liability
- Jobref recommends the use of legal software, including anti-virus software, to ensure safe use of the services provided by the Service.
- It is forbidden to send to Jobref, Advertiser, Advertiser, Referrer or Referrer information and content of an unlawful nature, offensive content, erroneous or misleading information, as well as content containing viruses or that may cause disruption or damage to computer systems and content that violates the rights of third parties.
- It is forbidden for Users to make available within the Service information and content of an unlawful nature, offensive content, erroneous or misleading information, as well as content that contains viruses or that may cause disruption or damage to computer systems and content that violates the rights of third parties.
§ 21 Technical requirements
- The Service recommends the use of legal software, including anti-virus software to ensure the safe use of the services provided by the Service.
- To use the functionality of the Service, you must:
- Have access to the Internet,
- have a modern browser that supports HTML5, CSS3 and JavaScript
- have an email account when selecting the subscription sign-up option,
- have enabled: Cookies, JavaScript and SSL.
§ 22 Complaints
- The employer, the user and third parties are entitled to file a complaint at any time.
- The complaint may concern the inconsistency of the provided service with the purchased one, violation of these Terms of Service or violation of the rights of the Announcer, the User or a third party.
- In the event of non-conformity of the service provided with the service purchased, the User has the right to demand correction of the non-conformity, reduction of the price of the service for the period of non-conformity, termination of the contract or payment of compensation if damage has been caused as a result of non-conformity.
- A complaint may be submitted in writing to the Jobref's address or by e-mail to the Jobref's address indicated in § 1.2.4 of the Terms of Service
- The complaint must contain the data necessary to investigate the claim:
- User designation,
- A description of what the non-compliance of the ordered service consists of or an indication of where the violation of the rights of the User or a third party took place, possibly indicating another reason for the complaint,
- The complaint should include the User's proposed method of handling the complaint. The same applies to third parties,
- Information about any damage caused.
- The time for processing a complaint is 21 working days from the date of successful delivery of a properly prepared complaint to the Service.
§ 23 Commercial information
- If the User consents to Jobref's processing of personal data in the form of name, surname and email address for the purpose of providing him/her with commercial information regarding services offered by Jobref by means of electronic communication, Jobref may send the aforementioned commercial information to the User's email address.
- The advertiser and the Advertiser may, without giving any reason, revoke their consent to receive commercial information at any time by sending an email to the email address specified in § 1.2.4 of the Terms of Service
- The consent referred to in paragraph 1 is a consent to receive commercial information at the e-mail address provided, within the meaning of Article 398 of the Act - Electronic Communications Law of July 12, 2024 and Article 10 paragraph 2 of the Act on Providing Electronic Services.
- The advertiser and the advertisee, as part of the services to which they have subscribed by accepting the Terms and Conditions or by giving their consent, may, if they give the appropriate consent, receive individualized commercial information electronically through the Service.
§ 24 Copyright Jobref
- The layout and formula of the content made available on the Website adopted on the Site is a self-contained subject of copyright protection.
- All rights to the content of the Service, including its graphic elements, the selection and layout of the Service's pages, content, logos, digital Content and other elements of the Service's website are reserved, unless expressly stated otherwise, and are subject to the exclusive rights of Jobref or third parties.
- The copyrights associated with the Service and the content referred to in paragraph 2 are protected by the Law on Copyright and Related Rights.
§ 25 Final provisions
- The Service reserves the right to make changes to the terms and conditions, including changes to the scope of Jobref's product/tool offerings and service prices.
- If the Terms and Conditions are amended, the new content will be published on Jobref.
- The new version of the Terms and Conditions will apply to products/tools that were purchased or started using them after the announcement of the change in the Terms and Conditions.
- The service reserves the right to place advertising content on the Jobref website in forms customary on the Internet.
- The Service is governed by Polish law, and all matters relating to the use of the services and account shall be governed by the relevant provisions of the laws of Poland.
- If any provision of the Terms of Service is declared invalid by a final court decision, the remaining provisions of the Terms of Service shall remain in effect.
- In matters not regulated by the Terms of Service, the provisions of the Law - Electronic Communications Law, the Law on Personal Data Protection, the Civil Code, the Law on Copyright and Related Rights, GDPR, as well as other relevant legal regulations shall apply.
